Do crippled people still have the right to drink?
I know the obvious answer is yes, you can’t take away someone’s rights just because they are crippled….but I was thinking today, and say they were "walking" home from a bar, on their wheel chair, couldn’t they get a DUI for that? I mean, I heard of someone getting a DUI for being drunk on a bicycle, so its not like there has to be a motor (which is what i used to think) but even if it does have to be a motor vehicle, what about power chairs? Can someone get a dui for driving a power chair under the influence? this doesn’t exactly seem fair, but its still a motor vehicle…right?
My opinion is…that probably you legally can get DUI for that, but no cop is gonna be that much of a prick and give one out….but who knows?
Any lawyers or anything actually know the answer?
Or anybody else want to put any input?

Yes, disabled people have a right to drink if they want to and if they are of a legal age to do so. But they still have to obey the laws and not drink and drive just like every one else does.
And yes they can get a D.U. I. if they are drunk and driving a motorized wheel chair of any sort, since it’s still considered a vehicle of sorts and it’s against the law for them to be driving around on it while drunk.
I don’t see that they would get any more of a break than any one else if they are driving drunk, since its against the law. So they would get treated the same as any one else.

I don’t know about the legalities of driving a motorized wheelchair, though, under the influence.
First of all, this is a ridiculous question. GET A LIFE.
Second, there is such thing as being drunk in public, which is a punishable offense.
Yes they can. People riding horses have been given tickets for being drunk in public.
It is quite fair to ticket an intoxicated person in a wheelchair. They are still a danger to themselves and others if not attended.
Good question..DUI, no. Any decent attorney would get that tossed out of court. Public Intoxication, YES. No different than if you were walking home.
I know a handicapped guy who gets DUI’s on a regular basis.
they wont (can’t?) take his van or license away because he is handicapped.
he has had at least ten DUI’s in the last few years and he still drives and has a legit license.

They can get lock up for public drunk.
